Abstract(s)

Nesta segunda parte do nosso estudo, prestamos atenção ao direito à saúde, tal como reconhecido no âmbito da UE, concentrando-nos no artigo 35º da CDFUE. E dado que esta norma prescreve (i) um direito, (ii) de solidariedade, (iii) à saúde - em que os Leitmotiven da Europa da Saúde, da Europa dos Direitos e da Europa Social parecem convergir e intersectar-se - o nosso objectivo vem a ser o de reconstituir as raízes históricas dessas três vertentes do projecto europeu, descrevendo os respectivos cursos evolutivos, enquanto afluentes que desaguam no artigo 35º, alimentando-o constantemente. Esperamos assim suscitar uma reflexão crítica, que abra novas possibilidades de evolução, ao fazer das marcas genéticas do artigo 35.º verdadeiros arrimos para repensar, imaginar, descobrir, projectar e realizar a contínua reconstrução crítico-regulativa do direito devotado à protecção e promoção da saúde na UE. ABSTRACT In this second part of the investigation we will focus our attention on the right to healthcare, as recognized by the UE, concentrating our thoughts exclusively on article 35º of the CFREU. And since this precept prescribes a (i) solidarity (ii) right (iii) to healthcare - where the Europe of Health, the Europe of Rights and Social Europe seem to converge and intersect - our goal comes to be the reconstitution of the historical roots of these three components of the European project, describing their evolutionary course, as if they were streams, flowing into article 35º, and continually feeding its content. By means of such a display, we hope to propel some critical reflection, opening new possibilities of evolution, and using the referred genetic marks of article 35º as true sources to rethink, imagine, project and enact the continuous regulative re-construction of the EU Law specifi cally devoted to health protection and promotion.
